Council considers any form of building activity or change of use of land as development unless specifically excluded by regulation.
Most forms of development unless they are specifically excluded under the Development Act & Regulations require a person to lodge an application with Council for Development Approval. Development Approval is a three stage process, consisting of Development Plan Consent, Building Rules Consent and Development Approval.
An application for Development Plan Consent is assessed against the Development Plan, which is the policy document administered by Council to ensure development occurs in an orderly manner. The matters considered include for example:
- the visual impact of the structure on adjoining properties and the street;
- the safety and convenience of proposed access points;
- the appropriateness of the intended use in relation to the character of the area and its zoning; and
- the intensity of developments and the amount of open area.
The State Planning system is currently in the process of significant planning reforms. As of September 2020 all Metropolitan and Regional Council’s will be transferred to the Planning and Design Code under the Planning, Development and Infrastructure Act 2016. The Planning and Design Code will replace all current Development Plans. Therefore, some areas may see shifts in the principles governing development in their area. Should an application for development or a land division be made after September 2020, it will be subject to the transitional provisions of the Planning, Development and Infrastructure Act 2016.

An application for building consent is assessed against the technical requirements of the Building Code of Australia and other relevant standards to ensure the structural sufficiency, fire safety, health and amenity of the structures are maintained.
